From August 25, 2023, platforms and search engines designated as VLOPs or VLOSEs must comply with the Digital Services Act (DSA), a European Union regulation that seeks to create a safer digital space with greater guarantees for users. Instagram, TikTok, Shein or Google Search are some of the designated services that must comply with the most demanding obligations.

As the authority in charge of supervising this group of large companies, the Commission has taken numerous decisions regarding possible non-compliance with different articles. For example, consultations on the moderation of illegal content and the spread of disinformation following the attacks between Hamas and Israel or the opening of investigations related to the protection of minors against addictive designs.

These decisions respond to a series of investigative and sanctioning powers that the DSA grants to the Commission, which responds to the following process to implement them.

In the event of a decision of non-compliance, the law establishes a series of sanctions that may not exceed 6% of the global annual turnover of the sanctioned company.
